Gardasil vaccine lawsuits have been reviewed by the United States Judicial Panel on Multidistrict Litigation (JPML). Upon due consideration, the JPML selected the Western District of North Carolina (WDNC) as the venue in which HPV vaccine injury claims would be heard by the federal court system.
The Western District of North Carolina is part of the 4th circuit of the U.S. court system, and appeals are heard by the Fourth Circuit Court of Appeals.
Consolidation of a multitude of Gardasil lawsuits in North Carolina’s Western District was done pursuant to 28 U.S.C. § 1407. Newly filed cases nationwide are expected to likewise be transferred the WDNC.
The WDNC was likely selected in large part because Gardasil manufacturer Merck & Co. is based in the state.

Judge Robert J. Conrad, Jr. is a distinguished figure in the legal community, celebrated for his unwavering commitment to justice and the law.
Judge Conrad earned his law degree from the University of Virginia School of Law. While at UVA, the future jurist focused his studies on constitutional law, civil rights, and the dynamics of legal advocacy.
Upon graduating, Conrad clerked for renowned federal judge, Hon. Pasco M. Bowman II of the United States Court of Appeals for the Eighth Circuit. Conrad went on to serve as an Assistant U.S. Attorney, where his prosecutorial work focused on corruption, organized crime, and financial fraud.
Judge Robert J. Conrad, Jr. was first appointed to the bench as a U.S. District Judge for the Western District of North Carolina in 2005 by President George W. Bush.
